1. Introduction & Acceptance of Terms

Welcome to Lavendr (the “Site”), operated by NECIONE LLC, doing business as Lavendr (“we,” “us,” or “our”). By accessing or using our website at withlavendr.com, placing an order, or subscribing to any of our programmes, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, please do not use the Site.

We reserve the right, at our discretion, to change these Terms on a going-forward basis at any time. Please check these Terms periodically for changes. In the event that a change to these Terms materially modifies your rights or obligations, we will make reasonable efforts to notify you of such change. We may provide notice through a pop-up or banner within the Site, by sending an email to any address you may have used to register for an account, or through other mechanisms. Generally, modifications to the Terms are effective upon publication, provided that if the changed Terms materially modify your rights or obligations, the changes are effective upon the earlier of (a) your using the Site with actual knowledge of the change, or (b) your acceptance of the modified Terms, and further provided that disputes arising under these Terms will be resolved in accordance with the Terms in effect at the time the dispute arose. If you do not accept the changed Terms, you may not continue to access and use the Site.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to make purchases on this Site. By using the Site, you represent and warrant that you meet this requirement.

3. Products & Availability

All product descriptions, images, and pricing on the Site are provided for informational purposes and are subject to change without notice. We make every effort to display colors and images accurately; however, we cannot guarantee that your device’s display will reflect the actual product perfectly.

We reserve the right to limit quantities, discontinue any product, or refuse any order at our sole discretion. If a product you ordered is unavailable, we will notify you and offer a refund or suitable alternative.

4. Pricing & Payment

All prices are listed in United States Dollars (USD) unless otherwise stated. Applicable taxes and shipping charges are calculated at checkout.

We accept major credit and debit cards as well as other payment methods displayed at checkout. By submitting your payment information, you represent and warrant that you are authorized to use the designated payment method. We reserve the right to cancel any order if payment cannot be verified or is suspected of fraud.

5. Order Confirmation & Cancellation

After placing an order, you will receive an email confirmation. This confirmation does not constitute acceptance of your order; it simply acknowledges that we have received it. We reserve the right to accept or decline your order for any reason.

If you need to cancel an order, please contact us at hello@withlavendr.com as soon as possible. Once an order has been shipped, it cannot be cancelled but may be returned in accordance with our Return & Refund Policy.

6. Shipping & Delivery

We currently ship within the United States. Estimated delivery times are provided at checkout and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our control. Risk of loss and title for items pass to you upon delivery to the carrier.

7. Returns & Refunds

If you are not satisfied with your purchase, you may request a return within 30 days of delivery. Items must be unused, in their original packaging, and in resalable condition. To initiate a return, contact us at hello@withlavendr.com.

Refunds will be issued to the original payment method within 5–10 business days of receiving the returned item. Shipping costs are non-refundable unless the return is due to our error.

8. The VIP Club Programme

Our 45-Day VIP Club Programme (“VIP Club”) is an optional auto-replenishment subscription designed to keep your favourites stocked and reward you along the way.

8.1 How It Works

When you enrol in the VIP Club, you authorise us to automatically charge the payment method on file and ship a refill of your selected product(s) every 45 days from the date of your initial order. In addition to each refill, you will receive a complimentary gift selected by our team at no extra cost.

8.2 Pricing & Billing

VIP Club members enjoy exclusive pricing as displayed at the time of enrolment. Prices may change, but we will notify you via email at least 7 days before any price increase takes effect. If you do not cancel before the next billing cycle, the updated price will apply.

8.3 Free Gifts

Each VIP Club shipment includes a free gift. Gift selection is at our sole discretion and may vary between shipments. Gifts have no cash value and cannot be exchanged or redeemed for credit.

8.4 Cancellation

You may cancel your VIP Club subscription at any time — there are no long-term commitments or cancellation fees. To cancel, email us at hello@withlavendr.com at least 5 business days before your next scheduled shipment date. Upon cancellation, you will not be charged for any future shipments, but you remain responsible for any shipments already processed.

8.5 Skipping or Pausing

Need a break? You can skip or delay your next shipment by contacting us at hello@withlavendr.com at least 5 business days before the next scheduled shipment date.

8.6 Returns on VIP Club Orders

VIP Club orders are subject to the same Return & Refund Policy described in Section 7. Free gifts included with VIP Club shipments are non-returnable and non-refundable.

9. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, images, product descriptions, and software — is the property of NECIONE LLC, doing business as Lavendr or its licensors and is protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

10. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorised access to any part of the Site, its servers, or any connected systems.
  • Interfere with or disrupt the Site or impose an unreasonable load on our infrastructure.
  • Use automated tools (bots, scrapers, etc.) to access or collect data from the Site without our written permission.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

11. Privacy

Your use of the Site is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your personal information.

12. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

OUR PRODUCTS ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE. THESE STATEMENTS HAVE NOT BEEN EVALUATED BY THE FOOD AND DRUG ADMINISTRATION. CONSULT YOUR HEALTHCARE PROVIDER BEFORE USING ANY SUPPLEMENT.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NECIONE LLC, doing business as Lavendr, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE PURCHASE OF ANY PRODUCT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless NECIONE LLC, doing business as Lavendr and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Site, violation of these Terms, or infringement of any third-party rights.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction in such courts.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and NECIONE LLC, doing business as Lavendr regarding your use of the Site.
